TextMeChat Privacy Policy

TextMeChat, a service provided by Star Gems Inc. (“TextMeChat,” “Star Gems,” “we,” “our,” or “us”), respects your privacy and is committed to protecting personal information collected through the TextMeChat platform and related services.

This Privacy Policy explains how we collect, use, disclose, and protect information when businesses and their customers interact through TextMeChat.

1. About TextMeChat

TextMeChat is a communications platform provided by Star Gems Inc. to participating retailers and other businesses (“Customers”). Our Customers use TextMeChat to communicate with their own customers and consumers (“End Users”) through SMS/text messaging and related communication tools.

When an End User provides a mobile phone number and consents to receive text messages from a participating Customer, that Customer is the sender of those communications. TextMeChat acts as the technology service provider supporting the messaging program.

2. Information We Collect

Depending on how you interact with TextMeChat or a participating Customer using TextMeChat, we may collect:

• Name
• Mobile phone number
• Email address
• Mailing or billing address
• Communications and message history
• Transaction and order-related information
• Communication preferences and SMS consent records
• Device, browser, IP address, and usage information
• Information voluntarily submitted through forms, widgets, or other TextMeChat features

We collect information that you provide directly, information provided when interacting with a participating Customer through TextMeChat, and limited technical information generated through use of the service.

3. How We Use Information

Information collected through TextMeChat may be used to:

• Provide and operate the TextMeChat service
• Enable participating Customers to communicate with their End Users
• Deliver transactional, informational, customer-care, and account-related communications
• Deliver promotional or marketing communications when the End User has provided the applicable consent
• Process transactions and support payment-related functionality
• Provide customer support
• Maintain SMS consent and opt-out records
• Improve the security, reliability, and functionality of TextMeChat
• Prevent fraud, abuse, and unauthorized activity
• Comply with applicable legal and regulatory requirements

We use mobile information only for purposes consistent with the services requested and the consent provided by the End User.

4. SMS/Text Messaging

Participating Customers may use TextMeChat to send SMS/text messages to End Users who have provided the appropriate consent.

Depending on the consent provided, messages may include customer-care communications; repair, order, or service updates; account notifications; appointment or pickup notifications; transactional or informational messages; and promotional offers, announcements, or marketing communications.

Promotional or marketing text messages are sent only when the End User has provided the applicable consent to receive those communications.

Message frequency varies. Message and data rates may apply.

End Users may reply STOP to opt out of text messages and HELP for assistance.

Consent to receive promotional or marketing text messages is not a condition of purchase.

Where different categories of SMS communications require separate consent, TextMeChat supports the collection of those consent choices separately.

5. Mobile Information and SMS Consent

Mobile information will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes.

Text messaging originator opt-in data and consent will not be shared with any third parties or affiliates for marketing or promotional purposes.

Mobile information may be disclosed only to service providers and telecommunications providers as necessary to operate the messaging service, deliver communications requested by the End User, provide technical or customer support, prevent fraud or abuse, comply with law, or otherwise support the services requested by the participating Customer and End User.

These service providers are permitted to use the information only as necessary to provide those services and not for their own independent marketing or promotional purposes.

6. How SMS Consent Is Collected

Participating Customers may collect SMS consent through TextMeChat-supported forms, website widgets, or other clearly disclosed opt-in methods.

Where a website form or widget is used:

• The End User voluntarily provides their mobile phone number.
• SMS consent is clearly disclosed.
• SMS consent controls are not preselected.
• End Users may decline SMS consent.
• Consent to receive promotional or marketing SMS is not required as a condition of purchase.
• Where transactional/informational and promotional/marketing consent are presented separately, the End User may make those selections independently.
• Acceptance of general Terms of Service or a Privacy Policy is not used as a substitute for SMS marketing consent.

The specific participating Customer requesting consent is identified within the applicable opt-in experience.

7. Opting Out of SMS Messages

End Users may revoke SMS consent at any time by replying STOP to a message.

After an opt-out request is processed, the End User will no longer receive messages covered by that opt-out unless the End User subsequently provides consent again.

End Users may reply HELP for assistance or contact the participating Customer from whom they are receiving messages.

8. How We Share Information

We may share personal information with service providers when reasonably necessary to provide and maintain TextMeChat, including providers that support telecommunications and message delivery, payment processing, hosting and infrastructure, security and fraud prevention, customer support, and technical operations.

We may also disclose information when required by law, legal process, or governmental request, or when reasonably necessary to protect the rights, safety, and security of TextMeChat, Star Gems Inc., our Customers, End Users, or others.

For clarity, mobile information and SMS opt-in data and consent are not shared with third parties or affiliates for their marketing or promotional purposes.

9. Participating Customers

Businesses using TextMeChat are responsible for their own interactions with End Users and for using TextMeChat in accordance with applicable laws, regulations, carrier requirements, and the consent provided by their End Users.

When an End User receives a message from a participating Customer, the participating Customer is the sender of that communication and TextMeChat provides the technology used to facilitate the communication.

Questions concerning a specific retailer’s products, orders, services, promotions, or communications should generally be directed to that retailer.

10. Data Retention

We retain personal information only for as long as reasonably necessary to provide TextMeChat, fulfill the purposes described in this Privacy Policy, maintain appropriate business and consent records, resolve disputes, enforce agreements, and satisfy applicable legal or regulatory requirements.

Information may be deleted, anonymized, or securely disposed of when it is no longer reasonably necessary for these purposes.

11. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, or misuse.

No electronic transmission or storage system can be guaranteed to be completely secure, and therefore we cannot guarantee absolute security.

12. Payment Information

TextMeChat may provide features that enable participating Customers to facilitate transactions or payments with End Users.

Payment information may be processed by payment processors or merchant service providers used to complete the transaction. Payment information is handled in accordance with applicable security requirements and the policies of the relevant payment provider.

13. Cookies and Similar Technologies

TextMeChat may use cookies and similar technologies to operate the service, maintain sessions, remember preferences, improve functionality, analyze service performance, and protect the security of the platform.

Browser settings may allow users to limit or disable certain cookies, although doing so may affect the functionality of the service.

14. Children’s Privacy

TextMeChat is not intended for children under 13, and we do not knowingly collect personal information from children under 13.

If we learn that personal information has been collected from a child under 13 without appropriate authorization, we will take reasonable steps to delete that information.

15. Your Choices and Rights

Depending on applicable law and your relationship with TextMeChat or a participating Customer, you may have rights concerning your personal information, including the ability to request access, correction, or deletion.

End Users seeking information specifically maintained by a participating Customer should contact that Customer directly.

For SMS communication preferences, End Users may reply STOP to opt out and HELP for assistance.

16. Third-Party Services

TextMeChat may integrate with or provide access to third-party services necessary to support platform functionality.

Third-party services may maintain their own privacy policies and terms. Their handling of information is governed by their applicable policies.

Notwithstanding the foregoing, mobile information and text messaging originator opt-in data and consent will not be shared with third parties or affiliates for their own marketing or promotional purposes.

17. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to TextMeChat, applicable requirements, or our privacy practices.

When changes are made, the “Last Updated” date at the top of this Privacy Policy will be revised.
